Congress Seeks to Expand Service members' Housing Rights
Legislation (S. 3179) to expand the protections currently available to military personnel under the Service members Civil Relief Act (SCRA) has been introduced in Congress. Currently, service members who are deployed or given transfer orders can terminate a lease without penalty. Under the proposed measure, service members would also be able to terminate a lease early and without penalty when base housing becomes available.
NAA/NMHC are currently assessing the bill’s effect on the industry and are reaching out to appropriate congressional offices for additional information. The bill may be added to the pending FY 2013 Defense Department authorization bill (S. 2467) currently working its way through the Senate. The House-passed version of the defense authorization measure (H.R. 4310) did not include the lease termination provision.
